Digital Millennium Copyright Act Notice

VPS.org respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Notice

If you believe that any material on VPS.org infringes upon any copyright which you own or control, you may send a written Notification of Alleged Copyright Infringement to our designated DMCA Agent.

Required Information

Your notification must include the following:

  1. Identify in sufficient detail the copyrighted work or intellectual property that you claim has been infringed so that we can locate the material
  2. Identify the URL or other specific location on VPS.org that contains the material that you claim infringes your copyright
  3. Provide the electronic or physical signature of the copyright owner or a person authorized to act on behalf of the owner
  4. Include a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  5. Include a statement that the information in your Notice is accurate and you attest, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf
  6. Include your name, mailing address, telephone number, and email address

DMCA Process

When VPS.org receives a proper Notice, we will:

  • Immediately remove or disable access to the allegedly infringing material
  • Terminate the accounts associated with the material (if applicable) in accordance with the DMCA
  • Notify the affected user of the takedown

Repeat Infringer Policy

VPS.org has adopted a policy of terminating, in appropriate circumstances and at its sole discretion, members who are deemed to be repeat infringers.

VPS.org may also, in its sole discretion, limit access to and/or terminate the use of VPS.org by anyone who infringes the intellectual property rights of others, whether or not there is repeat infringement.

Counter-Notification

If you believe that your content was removed in error or that you have the authorization to use the material, you may submit a counter-notification to our DMCA Agent with the following information:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your district

Important Notice

Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. If you are unsure whether the material infringes your copyright, you should contact an attorney before filing a DMCA notice.
